SUMMARY:

Numerous cases of crimes against female sexual dignity are recorded daily, one every ten minutes, according to data from the Brazilian Forum of Public 2021.  Among these occurrences, there is the crime that became nationally known as "Mariana Ferrer Case", in which the young Brazilian Mariana Borges Ferreira registered 2018 a complaint against the crime of rape of vulnerable, from that, the developments of the process revealed how the courts treat the victims of this type of crime. In view of this context, we established as the main objective to investigate how the text plan, the point of view and the enunciative responsibility are manifested in the discursive genres instruction hearing and acquittal sentence of the “Mariana Ferrer Case”. With regard to specific objectives, we propose to identify, describe, analyze and interpret: 1) how the compositional structure of the text plan of the instruction hearing and the sentence absolutory is constituted; 2) the way in which points of view and voices are mobilized in the two discursive genres; 3) the linguistic marks that indicate enunciative responsibility in the pretrial hearing and in sentence absolutory. Due to this scope, we sought to anchor in the theoretical assumptions of Textual Linguistics, Enunciative Linguistics, and Textual Analysis of Discourses. In this direction, we have authors who work with the text plan, among them, Adam (2011, 2019, 2020, 2021, 2022), Passeggi et al. (2010), Cabral (2013, 2016), Marquesi et al. (2019), Marquesi, Cabral and Rodrigues (2022), Rodrigues and Marquesi (2021), Rodrigues (2022a, 2022b); with the theory of points of view, based on Rabatel (2005, 2016, 2021a, 2021b), Soares and Rodrigues (2021); with the phenomenon of enunciative responsibility, from Adam (2011, 2019, 2020, 2021, 2022), Rabatel (2016), Passeggi et al. (2010), Rodrigues, Passeggi and Silva Neto (2010), Rodrigues (2017); and the mediation framework, through the postulates of Guentchéva (1994, 2011). Methodologically, this is a study that is part of the qualitative approach, descriptive and interpretative, using deductive and inductive methods based on bibliographic and documentary procedures. The corpus of the research consists of 1 (one) instructional hearing and 1 (one) sentence absolutory, both given in the proceedings of the “Mariana Ferrer Case”, public domain in digital environments. The analyses demonstrate a fixed or conventional text plan in both discursive genres. Regarding the point of view and enunciative responsibility, we found that in the hearing of instruction and judgment there is more evidence, certainly because it is a discursive genre that uses the oral language modality, because as there is interaction in the context of spoken language possibly establishes conditions for speakers to assume the propositional content of the statements in syncretism situation, thus becoming first enunciating speakers (L1/ E1); in the absolutory sentence, we note that the judge (L1/ E1), in some of the analyzed examples, employs multiple voices to support their decision, demonstrating positions of agreement or disagreement before the propositional content conveyed by the second enunciators (e2), as in the report sections and in some parts of the reasoning, while in the “device” section, we identify the PDV of L1/E1 and the assumption of RE.
