The right to health, including comprehensive therapeutic care, was recognized by the Federal Constitution of 1988 and materialized with the creation of the Unified Health System (SUS). Since then, despite advances in access to medicines, the number of actions requesting medicines and other health goods and services from the judiciary has grown, a phenomenon known as the Judicialization of Health. There are no data yet that reflect a national panorama on the profile of the plaintiffs. , the medications requested and the procedural and legal characteristics of these requests, with a concentration of studies in this regard in the Southeast and South of the country. The objective of this study is to analyze the individual lawsuits that request medications from the State of Rio Grande do Norte, in order to better understand the sociodemographic characteristics of the plaintiffs, the health and management characteristics of the Pharmaceutical Assistance (PA) of the claimed drugs, as well as the legal characteristics of the proceedings, in order to deepen the knowledge about the judicialization, exploring causes and possible consequences for public policies, and thus be able to assist the actors involved in decision making. A descriptive, exploratory and retrospective study was developed, whose unit of analysis was the individual processes requesting drugs in the State of RN, from 2013 to 2017.The results obtained are presented in two papers. The paper entitled “Judicialization in access to medicines: analysis of judicial demands in the state of Rio Grande do Norte” had the analysis of 987 cases, in which most of the authors were female (58.8%), aged between 19 to 59 years old (49.4%) and resident in the interior of the state (56.9%). There was a predominance of public legal assistance (52.8%) and origin of prescription in the private sector (38.1%). In 68% of cases, there was access to the drug, being the author responsible for the purchase in 56.1% of cases. Of the 1517 medications requested, 67.1% were not included in the National List of Essential Medicines (RENAME). The second paper whose title is “Judicialization of medicines: enforcement of rights or weakening of public policies? ”, Evaluated the medical-sanitary and management characteristics of PA regarding the drug policy in force at SUS. It was seen that 75% of medicines requested outside RENAME have a standardized alternative therapy, and that there is off-label use of medicines in 13.6% of cases. There was a statistically significant association between the origin of medical prescription and the request for medication outside RENAME, with greater non-adherence to the policy of prescribers of philanthropic and private health services. Even in the case of requesting medicines belonging to RENAME, there is disagreement with the standardized indications in SUS. The data show the consolidation of drug access through the judicial route, for the request of drugs not yet available by SUS. However, it is observed that there are alternatives in politics. Prescribers play a fundamental role in this process, and there is no adherence on the part of the therapies incorporated in the policy, or the indications proposed by the health system.
