RESUMO:

Background: The phenomenon of health judicialization can be defined as an increase in lawsuits requiring Public Administration access to various health technologies and services. The Union's spending on drug lawsuits represented a real increase of 547% between 2010 and 2016, from R$ 199.6 million to R$ 1.3 billion in 2016, with a total R$ 4.8 billion. Aim: To characterize the legal demands for medicines in the State of Rio Grande do Norte in relation to the financial aspect. Methodology: descriptive study of an exploratory nature. The unit of analysis is the individual legal proceedings concerning the year 2016 requesting medicines, filed against the State of the RN. A database was constructed by consulting the site of the Court of Justice of the RN, based on the register of patients provided by the Central Unit of Therapeutic Agents (UNICAT). The variables were divided into 4 groups: socio-demographic, medical-health, legal and financial. For the elaboration of the indicators, the Manual of Indicators for Evaluation and Monitoring of Drug Lawsuits (PEPE, 2011) was used, as well as indicators established by the researcher. Results: In the year 2016, R $ 5 million were spent on drugs, in contravention, according to SIOPS data, the resources of the account referring to the material, goods or service for free distribution, where the amounts available to the State of the RN for the purchase of medicines, were 8.5 million for the same year. In the midst of this reality, 110 lawsuits were analyzed where 221 drugs are requested in 2016, of which 62.7% of the perpetrators were women. The medical-sanitary data show that 44.3% of the medicines were present in RENAME; being 55.1% of the specialized component, 43.9% of the basic and 1% of the strategic one. The most requested drugs were those of the alimentary tract and metabolism with 22.8%, followed by those of the nervous system and the cardiovascular system, with 20.5% and 19.6% respectively. As for the legal information, 50.0% of the legal representatives were lawyers and 20.9% were public defenders, and 99.1% of the guardianship advances were deferred. Finally, the financial figures show that 45.4% of the purchases of medicines were made by the State and 35.4% by the patient; being fined for non-compliance with a decision in 73.6% of the cases.
