SUMMARY:

This research work proposes to analise the trajectory of use of legal apparatus of Just War while
a way that increased the process of deterritorialization of Capitancy of Rio Grande, especially
the area of Açu, in the late seventeenth century. When starting with the legal and theological
debates since the fifteenth century, it is intended to observe the developments of these
discussions in the pratical reality of colonizers when faced with several indigenous groups, to
whom it proposes a denaturalization’s process. Thereby, it can perceive a instrumentalization
of this legal apparatus, just not in the indigenous legislation, as also in the actions of authorities
and residentes who supported by the argument of just war, they could intesify the spread of
institutional frontiers and new territorializations in the Portuguese America. Through of the
discourse analysis produced by the colonial institutions and authorities, as Junta das Missões
de Pernambuco, and the crossing of sources it could perceive the proportions of justice’s
incidence about the wars against the indians, between 1680 and 1720, in the hinterland of Açu,
period that comprised the Guerra dos Bárbaros. So, the indians that espaciality, had to
reorganize while a group, in a new historical and expansionist context in the new spaces, in
view of the apropriations that had with their territories. The aim of this work is reflect
historically in the specific way about the discussions that deal of just wars in the Açu, paying
attetion to this part of Guerra dos Bárbaros so that it privileges a perspective turning to
indiginous protagonism, although of restriction represented by the bureaucratic character of the
sources.
