SUMMARY:

According to Article 225 of the Federal Constitution, the environment is an asset of common use and essential to healthy quality of life, and it is up to the community and the government to protect it for the present and future generations. Thus, through geoprocessing, thematic maps were produced with the distribution of Voluntary Delivery Points (VDP) in Brazil to diagnose the performance and adherence to the 12 Brazilian Reverse Logistics Systems (RLS). This research identified the states that stand out in this sense, that is: the federative units of the Southeast and South regions of Brazil, with emphasis on São Paulo. In light of this, the socio-environmental challenges faced by Brazilian RLSs were discussed. Next, the RLSs that demand more attention in terms of their development, due to the weaknesses identified, were indicated based on a discussion of five factors: interconnection of VDPs data to SINIR; mandatory implementation of the RLS by Art. 33 of the National Solid Waste Policy since its publication in 2010; identification of the managing entity of each RLS; existence of activity report on RLS performance; and the spontaneous or compulsory nature of the normative act on the implementation of the RLS. These factors were extracted from the selected analysis objects: periodic reports of RLSs activities; relevant legislation; sectoral agreements concluded; and programs of the managing entities linked to the SINIR website. In addition, the main legislations that deal more specifically with each RLS were listed and the environmental effects of the products subject to RLSs were discussed. Despite specific regulations, the post-consumption collect medicines is disarticulated in Brazil, aggravating drug-contamination. Using the FPSEEA matrix, this work aimed to understand the socio-environmental reality of the implementation of reverse logistics for medicines to minimize drug-contamination and achieve the SDGs. Thus, 18 socio-environmental variables were analyzed by the hierarchical cluster and K-means methods, defining three Brazilian scenarios: more developed (Southeast); less developed (North, Northeast and Center-West); and in development (South). Additionally, the response profile in terms of proposition and creation of legal provisions on reverse logistics for pharmaceuticals was analyzed and didn't demonstrate the transference of the notion of legislation related to an environmental practice. However, the form of final disposal of solid waste represented the relevance of the efficient implementation of the reverse logistics of pharmaceuticals laws. In addition, the actions of control, monitoring and environmental education were emphasized to reduce the impacts of pharmaceutical waste and promote sustainability.
