SUMMARY:

The recognition of human right to water and sanitation was instituted by the United Nations General Assembly in 2010, holding governments accountable to guarantee the population's access to sanitation and water through laws and programs. One of the instruments for citizens to exercise social control is through deliberations in municipal councils. Despite the legal requirement, 82.8% of Brazilian municipalities did not have municipal sanitation councils in 2018, which hinders equality and universal access to sanitation for the poorest. Due to the complexity and different faces of sanitation (technical, economic, environmental), only the mastery of technologies is insufficient to solve the sanitation problem.Therefore, the adoption of public policies, incorporating systemic conditions, must consider social, political and cultural processes. In the Brazilian scenario, there are legal conditions for the governance of sanitation through laws, regulations and standards; however, the gap that is intended to be filled is to investigate whether social participation represents the incorporation of society in the efficient and effective management of sanitation. This work aimed to evaluate the degreeof institutionalization of the participative councils. For this, a documentary survey of thecreation laws and the Internal Regulations (IR) of four councils related to the theme ofsanitation was carried out. It was identified that the Natal City Board – CONCIDADE and theMunicipalHealth Board- CMSwere more pluralized and democratic, while the Municipal Board of Basic Sanitation – COMSAB and the Council for Urban Planning and Environment – CONPLAM were less attached to democratic processes.
