SUMMARY:

The present study was based on a field research carried out primarily in the Forum Desembargador Arthur Almada Lima, in the judicial district of Caxias/MA, as well as in the Public Defender's Office, the Public Prosecutor's Office and the Brazilian Bar Association (Caxias Sub-Section). It is based on the monitoring and analysis of 15 jury sessions held in the first half of 2023. In this context, interviews were carried out, based on the three criminal courts with competence for the process and trial of the Jury Court, which comprise the cities of Caxias, São João do Sóter and Aldeias Altas. I interviewed defendants, relatives of the victim and of the accused, jurors, police officers, judges, Criminal Public Defenders, Criminal Prosecutors and lawyers who work in the jury. Among other things, the research reveals that the dramas of social life, conceptions of life and of the world, understandings about democracy and justice, and other aspects that we intend to understand, are present in the Jury Tribunal. The proposal is to base these analyses on an anthropological approach, and to apprehend its symbolic aspects and dialogue with referential research in the area, such as that of Schritzmeyer (2012), Figueira (2007), Picetti (2018), among others. It should be said, in passing, that despite the particularities of each research, they all dialogue with the democratic perspective of the Jury, recognizing this institute as democratic and/or criticizing this notion. After all, is the jury court really a democratic space or is this characteristic masked by other issues? The main purpose of this dissertation is to discuss this problematic.
