SUMMARY:

This dissertation aims to problematize the crossings and the overlays that Parental Alienation phenomenon involves. The family’s status change with marriage dissolution has also made latent conflicts and tensions within the family nucleus that have reverberated in an important way in society. From conflicts arising from the rupture of the marital relationship, especially in litigious divorces cases, the Parental Alienation phenomenon was noticed in 1985 by the psychiatrist Richard Gardner who called it Parental Alienation Syndrome. This phenomenon complexity has demanded a transdisciplinary analysis, associating law, psychology and anthropology, which, knowledge that, alone, does not offer intelligibility to the dimension that comprises this practice. From an exploratory aspect, based on a bibliographic study, interviews and conversations with comprise nucleus actors, such as legal operators, judges, lawyers, psychologists, and, especially, fathers and mothers who experience this practice. This paper tries to understand how these subjects deal directly with Parental Alienation dynamic and how they perceive within this phenomenon, the different types of violence linked to this dynamic. Putting on relief and analyzing the practice of Alienation as a form of psychological violence inferred from children who are subjected to this dynamic. This research also reflects through the interlocutor’s narratives as the roles socially constructed between men and women, act culturally as an important marker in the dynamics of Parental Alienation perception. Furthermore, through the experiences expressed by fathers, mothers and testimonies of children who suffered Parental Alienation, this thesis intends to demonstrate, as intertwining between affection and violence, they attribute a double and inseparable character to Parental alienation practice. Therefore, it is through an overlapping reality of invisibilities and imbricated power relations in the family environment that the need to problematize and question through the perception of law narratives operators, articulated the speeches of people who experience this conflict, whether from the from a personal point of view or from legal assistance, to the importance of revealing the intricacies of this phenomenon. Among other aspects, this study tries to highlight the relevance and the need to denaturalize this practice in our society.
