RESUMO:

The present study consists of a field research for dissertation of the master's degree in Social Anthropology of the Federal University of Rio Grande do Norte. The same has been developed with the objective of addressing the recent proposal to establish a custody hearing in our State - Rio Grande do Norte. I seek to understand the procedures of the hearing, the representation of the actors involved and to understand how access to justice is granted by flagrant (or flagrante) prisoners. From this perspective, I try to analyze the profiles of prisoners in this context, which, in my view, is of criminal selectivity and criminal subjection. In addition, I intend to analyze a little of what I perceived as police and institutional violence, which is increasingly present in judicial practices, strengthening punitive practices, reiterating hierarchies and fomenting cycles of inequality, power and revenge. The methodology is based on an ethnographic research, in which I performed observation, bibliographic analysis, qualitative, quantitative data, and informal conversations, open and semi-structured interviews. In this study, it is fundamental that the fundamental rights and guarantees of those most vulnerable to this criminal justice system, especially prisoners and their families, be seen and respected in the paths that seek justice and recognition as "being people", dignified citizens of their rights. In that sense, prison should function as an exceptional measure and not be the rule. Nevertheless, despite the formulation of new guidelines in this sense (and custody hearings are exemplary in this sense), the relationship between justice and punishment is still very strong and is present in this context. It is necessary, therefore, to have an adequate prison system as a whole so that the custody hearing is effective in what it proposes: that is, to investigate cases of torture allegations; to increase the access of vulnerable people to the criminal justice system, and to transform the prison sentence into something exceptional, not the ultimate rule.
