In Brazil, despite the constitutional recognition of health as a fundamental right and the largest publicly funded healthcare system by the State in terms of beneficiaries, there is still underfunding to the tune of $400 per capita annually. However, health judicialization has become a means of holding the State accountable for meeting healthcare needs. Nutrition and nourishment are crucial to the right to health, essential for preventing and treating nutritional problems, supported by the National Food and Nutrition Policy and the 1988 Federal Constitution. Specialized formulas, while they can be used for nutritional care aimed at recovery or maintenance of nutritional status, might be unfeasible due to their high cost and the difficulty of accessing them freely through the healthcare system. The present study aims to evaluate legal actions for the supply of nutritional formulas demanded against the state of Rio Grande do Norte during the period from 2017 to 2021. The study is of an exploratory descriptive type, using a database containing individual judicial process data filed against the state during the aforementioned period, along with a description and evaluation of the claimants' path through the system. A descriptive analysis of the data was conducted using Microsoft Excel version 2306, presented through tables and figures. A total of 132 active cases were identified. The majority of claimants are female (52.3%), from the child and adolescent population (42.5%), and the primary pathology leading to the prescription of nutritional formulas was nervous system disorders, accounting for 40.8% of the total. Regarding the claimants' place of origin, the majority came from the 7th health region of RN – Natal and the metropolitan area (42.9%). Asset seizure was a part of 54.5% of all cases, and the formula was prescribed by a nutritionist in 70.4% of cases, in contrast to medical prescriptions. Concerning the expenses incurred through legal demands for nutritional formulas and supplies in the state, the total accumulated during the assessed period was R$ 3,828,262.00, with an annual average of R$ 765,652.50 spent. Modified and pediatric formulas accounted for the majority of costs during the assessed period, at 44.6% and 44.1%, respectively. The average number of days between judicialization and the date of the court decision was 28.8 days, and the total time from judicialization to treatment was approximately 64.8 days. As a prospective conclusion of the study, there are plans to include a description of the claimant's journey, conclude the discussion of the topics covered, and prepare articles. It is worth highlighting that the field studied offers ample opportunities for further in-depth exploration and expansion. A promising direction for future research is the execution of longitudinal studies that track the evolution of spending aspects and cost-reduction strategies addressed in this current work.
